11/19 – Toms River Man Indicted on Charges He Failed Deliver Promised Generators Post-Sandy

FREEHOLD — A Monmouth County grand jury indicted a Toms River man on Monday for allegedly defrauding Monmouth County customers who paid him for natural gas generators in the aftermath of Sandy that were never delivered.
Brian Nogiewich, 54, was charged in the indictment with third-degree theft by deception and fourth-degree failure to register with the state Division of Consumer Affairs, according to the Monmouth County Prosecutor’s Office.
A joint investigation conducted by the Monmouth County Super Storm Sandy Fraud Task Force, overseen by the prosecutor’s office and the FBI, charged that Nogiewich had taken two deposits, one for a little less than $3,000 and another for $4,700, from two homeowners and that neither homeowner received the generator or a refund.
Authorities also charged Nogiewich’s application to register as a home improvement contractor with the Division of Consumer Affairs contained false information.
Nogiewich, if convicted, could face up to five years in prison on the third-degree offense and as much as 18 months on the fourth-degree charge, according to the prosecutor’s office.
Nogiewich is currently free on $50,000 bail.

The hours are 9 a.m. to 12:30 p.m. Tuesdays and 2 to 4:30 p.m. Thursdays.
